Heavy Construction Solutions (Aust) Pty Ltd (“HEAVY CONSTRUCTION SOLUTIONS”, “we”, “us” or “our”) is committed to protecting the privacy of personal information we collect and hold, and to handling it openly, fairly and transparently in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy sets out how HEAVY CONSTRUCTION SOLUTIONS collects, holds, uses and discloses personal information in the course of its business — including underground service locating, concrete scanning, structural investigation, mapping and related engineering services — and through this website.

This policy is governed by the laws of Victoria, Australia.

1. SCOPE

This policy applies to personal information we collect from or about:

• Clients, prospective clients and their representatives, including via enquiries, quotes and service bookings;
• Visitors to our website, including through cookies and analytics;
• Employees, contractors and job applicants, to the extent addressed by this policy;
• Suppliers, subcontractors and business partners.

It covers all HEAVY CONSTRUCTION SOLUTIONS operations across its Melbourne, Newcastle and Brisbane locations, and this website.

2. WHAT PERSONAL INFORMATION WE COLLECT

The personal information we collect depends on how you interact with us, and may include:

• Contact details — name, company name, email address, phone number, and mailing or site address;
• Enquiry and booking details — information provided through our “Get in Touch” and “Service Booking” forms, including the services requested, project or site address, preferred date and time, and any additional information provided;
• Communications — records of correspondence, including emails, phone calls, and information provided when requesting a quote or raising a query;
• Technical and usage information — automatically collected when visiting our website, including IP address, browser and device type, pages viewed, and referring website;
• Project information — where relevant to the services we provide, such as project scope, site conditions and technical requirements.

We do not intentionally collect sensitive information (such as health information or racial or ethnic origin) unless it is volunteered to us and necessary for the provision of our services, in which case we will only do so with consent or as otherwise permitted by law. We do not knowingly collect personal information from children.

3. HOW WE COLLECT PERSONAL INFORMATION

We collect personal information directly from individuals when they complete a form on our website, call, email or otherwise correspond with us, engage us to provide services (or act on behalf of a client engaging us), or interact with our website via cookies and analytics tools.

In some cases, we may collect personal information about an individual from a third party — for example, an employer, project manager or head contractor who engages us on their behalf — or from publicly available sources. Where practicable, we take reasonable steps to ensure the individual has been made aware their information may be provided to us in accordance with this policy.

4. WHY WE COLLECT, HOLD, USE AND DISCLOSE PERSONAL INFORMATION

We collect, hold, use and disclose personal information to:

• Respond to enquiries and provide quotes;
• Schedule, coordinate and deliver underground service locating, concrete scanning, structural investigation, mapping, permit coordination and other services;
• Communicate about a project, booking or service;
• Process payments and manage invoicing, where applicable;
• Maintain business records and comply with our legal, regulatory, taxation and insurance obligations;
• Improve our website and services, including through analytics;
• Meet our contractual obligations, including under our Terms and Conditions;
• Any other purpose an individual would reasonably expect, or to which they have consented.

We will only use personal information for the purpose it was collected, or a related purpose that would reasonably be expected, unless consent has been given for another use or we are otherwise required or permitted by law.

5. DISCLOSURE OF PERSONAL INFORMATION

We may disclose personal information to our employees, contractors and subcontractors who need the information to perform their duties; clients, head contractors or project managers, where relevant to the delivery of a service or project; our professional advisers, such as accountants, auditors and lawyers; IT and software service providers that support our business, including our website hosting provider and Google (for website analytics); government or regulatory bodies, where required by law — for example, Dial Before You Dig or Ground Penetration Permit processes; and any other party as required or authorised by law, or with consent.

We do not sell personal information to third parties.

Some third-party service providers we use — such as Google Analytics — may store or process personal information on servers located outside Australia. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure that recipient handles the information consistently with the APPs, or the disclosure is otherwise permitted under the Privacy Act 1988 (Cth).

6. COOKIES AND WEBSITE ANALYTICS

Our website uses Google Analytics to help us understand how visitors use our site. Google Analytics uses cookies — small text files stored on a visitor’s device — to collect information such as IP address, browser and device type, pages visited, and time spent on the site. This information is generally used in aggregated or de-identified form to improve our website and services.

7. DIRECT MARKETING

HEAVY CONSTRUCTION SOLUTIONS does not currently send marketing communications. If this changes, direct marketing (such as newsletters or service updates) will only be sent where permitted by law, and recipients will be able to opt out at any time by contacting us or using the unsubscribe function included in any such communication.

8. DATA QUALITY AND SECURITY

We take reasonable steps to ensure the personal information we hold is accurate, complete and up to date. We also take reasonable technical and organisational measures to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including secure website hosting, restricted access to records, and secure storage of physical and electronic files.

No method of electronic transmission or storage is completely secure, and absolute security cannot be guaranteed. Personal information is retained only for as long as necessary to fulfil the purpose it was collected for, or as required by law, such as taxation and record-keeping obligations.

9. ACCESS, CORRECTION AND COMPLAINTS

Individuals may request access to the personal information we hold about them, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Requests should be directed to us using the contact details in Section 11 below. We will respond within a reasonable time and may need to verify identity before providing access. In some circumstances access may be refused in accordance with the Privacy Act 1988 (Cth), in which case we will explain why.

If an individual believes we have breached the APPs or mishandled their personal information, they should contact us with as much detail as possible about the issue. We will investigate and respond within a reasonable time. If not satisfied with our response, a complaint may be lodged with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, or by phone on 1300 363 992.

10. DATA BREACHES

HEAVY CONSTRUCTION SOLUTIONS will take reasonable steps to prevent, and to respond promptly to, any unauthorised access to, or disclosure or loss of, personal information it holds. Where a data breach is likely to result in serious harm to an individual, we will comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the OAIC as required.

11. CHANGES TO THIS POLICY AND CONTACT US

This policy will be reviewed at least annually, and earlier if there are material changes to the Privacy Act 1988 (Cth), the Australian Privacy Principles, or our operations, website, or the personal information we collect. The current version was last updated on 1 July 2026.
